Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Volantyx website, applications, artificial intelligence tools, movement assessment services, training recommendations, athlete management tools, and related products and services (collectively, the "Platform").

By creating an account, accessing or using the Platform, purchasing or using Motion Credits, uploading or recording athlete content, or conducting an assessment, you agree to these Terms and our Privacy Policy.

If you use the Platform on behalf of a gym, sports performance facility, team, school, club, organization, or other entity, you represent that you are authorized to accept these Terms on behalf of that entity.

If you do not agree to these Terms, do not use the Platform.

1. The Platform

Volantyx provides AI-powered technology designed to assist coaches, trainers, sports performance professionals, facilities, and other authorized users in evaluating and developing athletic movement.

The Platform may analyze general athletic movements and sport-specific movements, including running, sprinting, acceleration, deceleration, jumping, landing, change of direction, football throwing mechanics, route-running mechanics, basketball shooting mechanics, baseball and softball movements, and other athletic activities.

Depending on the assessment selected, the Platform may generate:

  • Movement scores
  • Mechanical observations
  • Movement deficiencies
  • Performance insights
  • Comparisons
  • Recommended drills
  • Training recommendations
  • Development programs
  • Progress reports
  • Other AI-generated information

Available assessments and functionality may change over time.

2. AI-Generated Assessments

The Platform uses artificial intelligence, computer vision, algorithms, and other automated technologies to analyze athletic movement.

AI-generated results are estimates and should be treated as supplemental coaching information.

Assessments may contain errors, inaccuracies, incomplete observations, or recommendations that are inappropriate for a particular athlete.

Assessment accuracy may be affected by factors including:

  • Camera angle
  • Camera movement
  • Lighting
  • Video quality
  • Athlete visibility
  • Clothing
  • Obstructions
  • Recording distance
  • Environmental conditions
  • Athlete effort
  • Equipment
  • Limitations of the Platform's technology

Volantyx does not guarantee the accuracy, completeness, or effectiveness of any assessment.

Users must exercise their own professional judgment when interpreting and applying Platform results.

3. Not Medical Advice

THE PLATFORM IS AN ATHLETIC PERFORMANCE AND COACHING TOOL. IT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

The Platform is not intended to provide or replace:

  • Medical diagnosis
  • Injury diagnosis
  • Physical therapy
  • Rehabilitation
  • Medical treatment
  • Medical clearance
  • Injury-risk diagnosis
  • Healthcare services
  • Advice from a licensed healthcare professional

A movement score, identified deficiency, training recommendation, or other Platform output should not be interpreted as a determination that an athlete is healthy, injured, or medically safe to participate in an activity.

Athletes experiencing pain, injury, dizziness, unusual discomfort, or other health concerns should stop the relevant activity and seek guidance from an appropriate healthcare professional.

4. Coach and Facility Responsibility

The Platform is intended to assist—not replace—qualified coaches, trainers, and sports performance professionals.

Coaches, facilities, and other users remain responsible for all training and athlete-development decisions.

Users are responsible for determining:

  • Whether an assessment is appropriate
  • Whether a recommended drill is appropriate
  • Whether an athlete can safely perform an activity
  • Appropriate training intensity and volume
  • Whether appropriate supervision is available
  • Whether equipment and facilities are safe
  • Whether an AI recommendation should be modified, ignored, or replaced

Users should never blindly follow an AI-generated recommendation when their professional judgment indicates otherwise.

5. Athlete Accounts and Profiles

Authorized users may create athlete profiles and maintain athlete assessment histories through the Platform.

Information associated with an athlete may include:

  • Name
  • Age or age range
  • Sport
  • Position
  • Team
  • Video recordings
  • Assessment history
  • Movement scores
  • Training recommendations
  • Development plans
  • Other information submitted or generated through the Platform

Users must only create profiles for athletes they are authorized to manage through the Platform.

6. Athlete Videos and Content

Users may record or upload videos, images, and other content for analysis ("Athlete Content").

By submitting Athlete Content, you represent and warrant that:

  • You have the legal right to submit the content
  • You have obtained all permissions and consents required by applicable law
  • The recording was obtained lawfully
  • The content does not violate another person's privacy or intellectual property rights
  • You are authorized to have the content processed through the Platform

Users may not secretly record individuals or upload recordings without appropriate authorization.

7. Minor Athletes

The Platform may be used in connection with athletes under the age of 18.

Coaches, facilities, teams, schools, clubs, and other organizations are responsible for obtaining all parent, guardian, or other legally required permissions before submitting information about a minor athlete.

Where required, such consent must authorize activities including:

  • Recording the athlete
  • Uploading athlete videos
  • Creating an athlete profile
  • Processing video using artificial intelligence
  • Performing movement analysis
  • Generating assessment reports
  • Storing assessment history
  • Generating development recommendations
  • Sharing authorized information with coaches, facilities, parents, guardians, or other approved users

Creating an athlete profile does not by itself establish that legally sufficient parent or guardian consent has been obtained.

Volantyx may require additional consent or verification before processing information concerning a minor.

8. Parent and Guardian Access

Where parent or guardian access is available, it may be limited to specific information authorized for sharing.

Parents may receive information such as:

  • Assessment results
  • Athlete progress
  • Development recommendations
  • Assigned drills
  • Reports shared by the athlete's coach or facility

Parent access does not automatically provide coaching, administrative, billing, or facility-management privileges.

9. Video and Movement Processing

By submitting Athlete Content for assessment, you authorize Volantyx and its service providers to process that content as reasonably necessary to provide and operate the Platform.

Processing may include:

  • Detecting body landmarks
  • Estimating body position
  • Tracking movement across video frames
  • Measuring movement patterns
  • Analyzing body and joint relationships
  • Identifying movement characteristics
  • Comparing movements
  • Generating scores
  • Producing observations
  • Generating training recommendations
  • Creating development plans

10. Ownership of Athlete Content

Volantyx does not acquire ownership of an athlete's original video merely because it is uploaded to the Platform.

Users retain whatever ownership rights they otherwise possess in content they lawfully submit.

By submitting content, users grant Volantyx a limited license to host, store, reproduce, process, analyze, transmit, and display that content as reasonably necessary to operate and provide the Platform.

This license does not authorize Volantyx to publicly sell or publish identifiable athlete videos for unrelated marketing purposes without additional authorization.

11. AI Development and Model Training

Submitting Athlete Content for an assessment does not automatically grant Volantyx unrestricted permission to use identifiable athlete videos to train unrelated commercial artificial intelligence models.

If Volantyx offers programs involving additional use of Athlete Content for research, model improvement, or AI development beyond what is reasonably necessary to provide the Platform, any additional permissions required by applicable law will be obtained separately.

Aggregated or de-identified information may be used to operate, secure, evaluate, and improve the Platform where permitted by applicable law and described in the Privacy Policy.

12. Biometric and Sensitive Information

Certain movement-analysis technologies may process information that is treated as biometric, sensitive, or otherwise specially protected information under applicable law.

Volantyx will process such information in accordance with applicable law and its Privacy Policy.

Users may not knowingly submit information requiring consent or authorization that has not been properly obtained.

13. Motion Credits

Certain Platform functionality requires Motion Credits.

Different assessments may require different numbers of Motion Credits based on assessment complexity.

Current assessment costs may include:

  • ACS Level 1: 1.25 Motion Credits
  • ACS Level 2: 1.50 Motion Credits
  • ACS Level 3: 1.75 Motion Credits
  • Sport-Specific Assessment: 2.00 Motion Credits

Examples of sport-specific assessments may include football throwing mechanics, route-running mechanics, basketball shooting mechanics, baseball pitching mechanics, and similar sport-specific movements.

The required number of Motion Credits will be displayed before an assessment begins whenever reasonably practicable.

Volantyx may change credit requirements for future assessments.

14. Credit Packages and Bonus Credits

Users may purchase Motion Credits through available packages.

Packages may include bonus credits. For example:

  • 40 purchased credits + 10 bonus credits
  • 100 purchased credits + promotional bonus credits
  • 250 purchased credits + promotional bonus credits
  • 500 purchased credits + 100 bonus credits

Current pricing and bonus amounts will be displayed at the time of purchase and control over examples contained in these Terms.

Bonus and promotional credits:

  • Have no cash value
  • Cannot be redeemed for cash
  • Cannot be transferred unless expressly permitted
  • May be subject to promotional restrictions
  • May be discontinued or modified for future promotions

Motion Credits are not currency, bank deposits, securities, or financial accounts.

15. Free Credits

Volantyx may provide new users, facilities, promotional participants, or other customers with free Motion Credits.

Free credits are promotional and have no cash value.

Users may not create multiple accounts, falsify information, or otherwise manipulate the Platform to obtain additional promotional credits.

We may revoke fraudulently obtained promotional credits.

16. Credit Deduction and Failed Assessments

Motion Credits should ordinarily be deducted when an assessment is successfully initiated and processed according to the Platform's billing logic.

If an assessment cannot be completed because of a verified Platform technical failure, Volantyx may automatically or manually restore the affected credits.

Credits ordinarily will not be restored because:

  • A user disagrees with an assessment
  • An athlete performs poorly
  • The result differs from a coach's opinion
  • A recording submitted by the user is unsuitable for analysis
  • The user changes their mind after an assessment has been processed

17. Payments and Refunds

Prices are displayed before purchase.

Except where required by law or expressly stated otherwise, purchases of Motion Credits are final once credits have been used.

Unused purchased credits may be subject to the refund policy displayed at the time of purchase.

Taxes, payment-processing requirements, and other charges may apply where required.

18. Account Security

Users are responsible for:

  • Maintaining accurate account information
  • Protecting passwords and credentials
  • Restricting unauthorized access
  • Managing staff permissions
  • Removing former employees or coaches from facility accounts
  • Reporting suspected unauthorized access

Users are responsible for activity occurring through their accounts to the extent permitted by applicable law.

19. Acceptable Use

Users may not:

  • Upload content without appropriate authorization
  • Harass, exploit, or endanger athletes
  • Conduct unlawful surveillance
  • Attempt to access another organization's information
  • Manipulate assessment or credit systems
  • Circumvent Platform security
  • Introduce malicious software
  • Interfere with Platform operations
  • Reverse engineer protected Platform technology except where permitted by law
  • Scrape or systematically extract Platform data without authorization
  • Use athlete information for unauthorized purposes
  • Use the Platform in violation of applicable law

Accounts violating these requirements may be restricted, suspended, or terminated.

20. Platform Intellectual Property

Except for user-owned content and third-party materials, Volantyx owns or licenses the intellectual property associated with the Platform, including its:

  • Software
  • User interface
  • Assessment frameworks
  • Assessment Complexity Score system
  • Scoring methodologies
  • AI workflows
  • Algorithms
  • Drill-mapping systems
  • Reports
  • Platform architecture
  • Branding
  • Proprietary technology

Access to the Platform does not transfer ownership of these materials to users.

21. Athletic Performance Disclaimer

Volantyx does not guarantee any particular athletic outcome.

Use of the Platform does not guarantee:

  • Increased speed
  • Increased strength
  • Improved mechanics
  • Improved athletic performance
  • Reduced injury risk
  • Playing time
  • Team selection
  • Scholarships
  • Recruiting opportunities
  • College admission
  • Professional athletic opportunities
  • Any specific performance result

Athletic development depends on numerous factors beyond the Platform's control.

22. Assumption of Athletic Risk

Sports and physical training involve inherent risks, including risk of injury.

Users are responsible for ensuring that training activities are performed in appropriate environments, with appropriate supervision, equipment, instruction, and safety precautions.

To the maximum extent permitted by applicable law, Volantyx is not responsible for injuries resulting from a user's independent decision to perform or prescribe a particular activity based on Platform information.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

23. Platform Availability

We continually develop the Platform and may add, modify, replace, or discontinue functionality. This may include changes to:

  • Sports
  • Assessments
  • AI models
  • Scores
  • Drills
  • Development plans
  • Reports
  • Credit pricing
  • Credit requirements
  • Other Platform functionality

We do not guarantee that the Platform will always be available, uninterrupted, secure, or error-free.

24. Third-Party Services

The Platform may rely on third-party infrastructure, payment processors, cloud providers, AI providers, communication services, and other technology partners.

Use of certain third-party services may be subject to additional terms.

Volantyx is not responsible for third-party services to the extent permitted by applicable law.

25. Termination

Users may stop using the Platform at any time.

Volantyx may restrict, suspend, or terminate accounts for reasons including:

  • Violation of these Terms
  • Fraud
  • Credit manipulation
  • Unauthorized use of athlete information
  • Illegal activity
  • Security threats
  • Material misuse of the Platform

Rights concerning personal information and Athlete Content following termination are governed by the Privacy Policy and applicable law.

26. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE."

VOLANTYX DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT AI-GENERATED ASSESSMENTS WILL BE ACCURATE, COMPLETE, ERROR-FREE, OR APPROPRIATE FOR EVERY ATHLETE.

27. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOLANTYX, ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE PLATFORM.

Nothing in these Terms limits liability that cannot legally be limited.

28. Indemnification

To the extent permitted by applicable law, users operating the Platform on behalf of a business, facility, team, school, club, or other organization agree to defend, indemnify, and hold harmless Volantyx and its affiliates, officers, employees, and agents from third-party claims arising from:

  • Athlete Content submitted without required authorization
  • The organization's violation of these Terms
  • Unlawful use of athlete information
  • The organization's training decisions
  • The organization's violation of applicable law

This provision does not apply where prohibited by law.

29. Changes to These Terms

We may update these Terms as the Platform evolves.

If changes materially affect users' rights or obligations, we will provide notice where required by law.

The updated Terms will display a revised "Last Updated" date.

Where permitted by law, continued use of the Platform after updated Terms become effective constitutes acceptance of those Terms.

30. Governing Law and Dispute Resolution

These Terms will be governed by the laws of the State of [STATE], without regard to conflict-of-law principles.

Any dispute arising from these Terms or use of the Platform will be resolved in accordance with the dispute-resolution procedures established by Volantyx and applicable law.

31. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

32. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements applicable to specific Platform services, constitute the agreement between you and Volantyx regarding use of the Platform.
